Website terms for Alconite consulting, custom development, design, and infrastructure services
These terms govern use of the Alconite website and set the baseline rules for informational materials, inquiries, and future service discussions.
Website content is informational, may change at any time, and should not be treated as a binding project commitment.
Do not send confidential or export-controlled information through the public website unless Alconite has agreed in writing to receive it.
Pricing, deliverables, acceptance criteria, support, timelines, service levels, and ownership terms belong in separate project documents.
1. Acceptance and scope
By accessing or using this website, you agree to these terms. These terms govern your use of the public Alconite website and related informational materials, including any contact or inquiry flow made available through the site.
If you do not agree with these terms, do not use the website.
2. Informational use only
The website is provided for general business and marketing information about Alconite's services, capabilities, and evolving product plans. While Alconite aims to keep the information accurate and current, the site may contain omissions, forward-looking statements, roadmap language, or outdated references.
Nothing on the site should be interpreted as legal advice, security advice, tax advice, managed-service guarantees, or a binding commitment to deliver any particular feature, product, staffing model, schedule, or result.

4. No confidentiality obligation through the public site

5. Service engagements and commercial terms
Any consulting, implementation, design, development, hosting, support, or infrastructure services from Alconite are subject to separate written commercial terms. Those project documents may address pricing, payment timing, acceptance, change control, ownership, confidentiality, service levels, warranties, support boundaries, and termination rights.
Statements on the website about services, products, or operating models are descriptive only and do not create an offer that Alconite must accept or perform.
6. Intellectual property
The website, branding, copy, layout, graphics, logos, and related materials are owned by Alconite or its licensors and are protected by applicable intellectual property laws.
Except for limited personal or internal business review, no license or ownership right is granted by your use of the site. Project-specific intellectual property rights, including any assignment or license of deliverables, must be set out in a separate written agreement.

Alconite disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation, except to the extent a warranty cannot lawfully be disclaimed.
Alconite does not warrant that the website will always be free from errors, downtime, security incidents, or compatibility issues.
9. Limitation of liability
To the maximum extent permitted by law, Alconite will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the website or these terms, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.
If Alconite is found liable for a claim arising from the website itself, Alconite's total aggregate liability for that claim will not exceed one hundred U.S. dollars or the amount you paid, if any, specifically for access to the website, whichever is greater. This limitation does not override liability that cannot be limited under applicable law.
10. Indemnity
You agree to defend, indemnify, and hold harmless Alconite, its officers, directors, employees, contractors, and affiliates from claims, liabilities, damages, and expenses arising from your misuse of the website, your violation of these terms, or your infringement of another person's rights.
11. Governing law and disputes
Unless a separate signed agreement states otherwise, these terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for disputes relating to the website or these terms will lie in the state or federal courts located in or serving Dallas County, Texas, unless applicable law requires a different forum.
12. Changes and contact
Alconite may update these terms from time to time by posting the revised version on the website. Continued use of the website after an update becomes effective constitutes acceptance of the revised terms.

Important
A website visit is not a services agreement.
Any custom software development, design, infrastructure rollout, support, or consulting engagement with Alconite requires a separate written agreement, proposal, statement of work, order form, or similar contract signed by the parties. If a signed project agreement conflicts with these website terms, the signed project agreement controls.
